GENERAL CONTEST RULES
LIVE 105/ KITS-FM San Francisco
1. How to Enter the Contest
There are specific contest rules for each contest on LIVE 105 but in general, you will need to be the designated caller or texter at the designated time or when you hear the designated song or on-air solicit to call or text, to be announced on-air. Please note that if the contest involves listening for a specific song, the song must be heard on the air and not on the LIVE 105 web stream. On occasion, you will also be able to enter the contest online on this website. Age restrictions may also apply for specific contests, especially those involving trips. If a caller is under age for a contest that has an age restriction, the prize will not be awarded and there will be no alternate prize.
2. Eligibility Restrictions
a. The contest is open to all KITS-FM/LIVE 105 listeners who are 13 years of age or older, unless specified differently in specific contest rules and who legally reside in San Jose/Oakland/San Francisco Bay Metropolitan Area. Employees of KITS-FM/LIVE 105, its licensee, corporate parent, affiliated entities, its affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the San Jose/Oakland/San Francisco Bay metropolitan area and the members of their immediate families are ineligible to participate or win.
b. Entrants are eligible to win a prize valued at $600.00 or more only once every six months. Entrants are eligible to win a prize valued at $50.00 or more only once every thirty days. Only one winner per household is permitted in any contest.
c. For internet contests, add: To enter online, you must enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form. One Internet entry per person and one Internet entry per email address. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online serve provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address.
d. For internet contests: Contestants are required to provide truthful information and KITS-FM/LIVE 105 will reject and delete any entry that it discovers to be false or fraudulent. KITS-FM/LIVE 105 will also disqualify and delete any entry received from persons under the age of 13.
3. Internet Contest Privacy Policy:
a. We do not sell, lease, exchange or disclose your personally identifiable information with third party non-affiliated persons other than our sponsors or partners, unless it is required by law, or disclosure is necessary to those persons that operate our website, manage our contests/events and conduct prize fulfillment (“operational providers?), and to protect the safety of our visitors, employees or property. We also expect our operational providers to protect privacy.
b. Our contests, sweepstakes and special events are often produced with the generous support of non-affiliated sponsors and/or promotional partners. The personally identifiable information contestants voluntarily provide on our website may also be used for the marketing of additional events, services, and goods by KITS-FM/LIVE 105, our parent company and affiliated station, and our sponsors or partners. Please be informed that our sponsors or promotional partners may not have the same privacy policies that we do. If you do not wish to receive such additional marketing information or updates from KITS-FM/LIVE 105 and/or our sponsors or partners, you should check the box(es) so indicated in the contest registration area. However we maintain the rights to disclose any and all databases collected by the website(s) in the event that the assets or stock of KITS-FM/LIVE 105, or its corporate licensee or parent company, are sold or transferred. KITS-FM/LIVE 105 may provide aggregate statistics about our contestants, traffic patters, and related website information to reputable third-party vendors, but these statistics will not include personally identifying information.
4. Prizes:
a. Prizes for specific contest are disclosed on-air and/or LIVE105.com.
b. All prizes or prize certificates may be picked up at the office of KITS-FM/LIVE 105, 865 Battery, San Francisco, CA 94111. The winner will forfeit any prize or prize certificate not claimed within forty-five days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. KITS-FM/LIVE 105 is not responsible for the safe arrival of a prize or prize certificate.
c. Contest prizes are not transferable. Prizes may not be substituted or redeemed for cash.
5. Selection of Winners
a. Decision of station management with respect to the contest are final. Selection of winners for specific contests will be disclosed on KITS-FM and/or LIVE105.com
6. Conditions
a. Payment of all federal, state and local taxes is solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold KITS-FM/LIVE 105, its corporate licensee, its parent corporations, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. For Internet contests: KITS-FM/LIVE 105, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the KITS-FM LIVE 105 Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. KITS-FM/LIVE 105 reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement.
f. No purchase is necessary. The contest is void where prohibited.
g. Failure to comply with the contest rules may result in a contestant’s disqualification.
h. KITS-FM/LIVE 105 is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
i. Copies of the written contest rules are available during regular business hours at the main studio of KITS-FM/LIVE 105, 865 Battery, San Francisco, CA 94111. |
