OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. HOW TO ENTER
a. The LIVE 105 Hootenanny Contest will begin on Friday, June 13th, 2008 at 3:00 pm Pacific Time (“PT”) and end on Wednesday, June 18, 2008 at 3:00 pm PT (the “Contest Period”).
b. To participate in the Contest, listeners will need to submit an original video of themselves only playing any Weezer song acoustically. Participants will need to submit their videos online at www.live105.com. All videos will be reviewed and judged on creativity, originality and musical ability. Judges will have final decision on all entries. Contestants will be required to accept the conditions of the electronic video submission release form before entering and uploading their video. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for this Contest. Deadline for submission of entries is , June 18, 2008 at 3:00 pm PT.
c. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
d. You may enter once during the Contest Period.
e. Videos submitted as part of this Contest must be the original creative video work and must not contain materials or any other materials, which may be restricted, prohibited, or outlawed by Federal, state or local laws. All videos entries and their content become the property of the Station and will not be returned. The Station, in its sole discretion, reserves the right to disqualify and/or destroy any video entry if such video entry contains illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such video entry contains material whose content is deemed at the sole discretion of The Station to be unsuitable for public viewing or posting via the Internet.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all LIVE 105 listeners who are 18 years of age or older and legally reside in the San Jose/San Francisco Bay Area. Employees of KITS LIVE 105 (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the greater San Jose/San Francisco Bay metropolitan areas and the members of their immediate families are ineligible to participate or win.
b. Listeners are eligible to win a prize valued at $600.00 or more only once every six (6) months. Entrants are required to provide truthful information in all Contest entries and LIVE 105 will disqualify any entry that LIVE 105 determines to be false or fraudulent. Live 105 will also disqualify any entries received from persons under the minimum age required for this Contest, and also from entries received from persons under the age of thirteen (13) in compliance with the Children’s Online Privacy Protection Act.
c. Winner is responsible for any taxes owed on prizes. The Station reserves the right to amend or change these rules. LIVE 105 is not responsible for any damages or injuries that may occur, directly or indirectly, with regard to the award, use or delivery of any prize. Winner may be required to sign an affidavit of eligibility and liability and publicity release before receiving any prize. Failure to comply with deadline to return them may result in forfeiture of prize and selection of an alternate winner.
3. PRIZES
a. Forty (40) winners will each win two (2) passes to attend a private Weezer Hootenanny on June 20th, 2008 at Albert H. Dewitt Officer’s Club in Alameda. Each winner will also be given the opportunity to play an instrument on stage with Weezer for at least one (1) song. Due to the number of winners, each winner may not be on stage with Weezer individually. Seat locations to be determined by the Station. The Station reserves the right to remove or to deny entry to winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the concert. Approximate Retail Value of each prize is $100.00.
b. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within two (2) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of LIVE 105 management with respect to the Contest are final.
b. Forty (40) winners will be selected by a panel of judges including the Station Program Director, Promotions Director, Music Director, and Web Director from all entries by Wednesday, June 18th, 2008. The panel of judges will be judging all entries based on how well they perform, how well they know the Weezer songs, and if they had any extra creative efforts. The 37 winners will be notified by telephone by Thursday, June 19th, 2008.
c. Winners do not need to listen or be present to win.
d. Odds of winning depend on number of entries received.
e. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within two (2) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by random drawing.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
f. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
h. Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of LIVE 105. 865 Battery Street, San Francisco, CA 94111.
6. INTERNET SWEEPSTAKES PRIVACY POLICY
a. By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: www.live105.com.
