• NON-COMPLIANCE WITH ANY OF THE FOLLOWING OFFICIAL CONTEST RULES WILL RESULT IN DISQUALIFICATION.
• CBS 5 (KCBS/Live 105/KFRC) and GOODGUYS ROD & CUSTOM ASSOCIATION (collectively referred to as “Co-Promotional Partners”) DO NOT CONTROL THE NUMBER OF ENTRIES RECEIVED SO THE ODDS OF WINNING DEPEND ON THE TOTAL NUMBER OF ENTRIES.
1. To enter the 2009 Giveaway Contest for the 1965 Buick Le Sabre, you must do one of the following:
A) Sign up “In-Person” by locating a CBS 5, KCBS, KITS Live 105, and/or KFRC (the “Stations”) booth at the following 2009 GoodGuys Events which will be held at the Alameda County Fairgrounds in Pleasanton, California and complete an official entry form, while supplies last, prior to the booths daily deadlines. Include your first and last name, complete address including zip code, telephone number, and date of birth in the entry form. The Stations are not responsible for lost, stolen, mangled, misdelivered, illegible, incomplete or late entries.
• 27th All American Get-Together (March 28-29, 2009 each day from 8:00am until 3:00pm PT) at the Stations’ booth,
• 16th Summer Get-Together (May 30-31, 2009 each day from 8:00a until 3:00pm PT) at the Stations’ booth,
• 23rd West Coast Nationals (August 22-23, 2009 each day from 8:00am until 3:00pm PT) at the Stations’ booth, and
• 20th Autumn Get-Together (November 14-15, 2009 each day from 8:00am until 3:00pm PT) at the Stations’ booth;
B) Sign up “On-Line” starting on March 16th at 10:00am Pacific Time (“PT”) and ending on November 6, 2009 at 12:00PM PT, log on to one of the following Station website: www.cbs5.com, www.kcbs.com, www.live105.com, and www.kfrc.com. Follow the links on the website to enter the GoodGuys Buick Le Sabre Giveaway (the “Contest”) to become an On-line Participant (hereinafter referred to as “On-Line Participants”). Upon successful completion of the on-line information you will be automatically entered as an On-line Participant. Enter your first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. For purposes of these Official Contest Rules, “receipt” of an online entry will be solely determined when the Stations’ web servers record the entry information. Any automated computer receipt (such as one confirming delivery of an email) does not constitute actual receipt of an entry for purposes of these Official Contest Rules. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Stations and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Stations. Stations’ computer is the official time keeping device for the Contest. The Stations are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. All entries must be received by November 6, 2009 at 12:00PM PT.
C) Be an Official GoodGuys Participant by registering and then entering your vehicle for the following 2009 GoodGuys Weekend Events (ONLY) which will be held at the Alameda County Fairgrounds in Pleasanton, California:
• 27th All American Get-Together (March 28-29, 2009),
• 16th Summer Get-Together (May 30-31, 2009),
• 23rd West Coast Nationals (August 22-23, 2009), and
• 20th Autumn Get-Together (November 14-15, 2009).
[This does NOT include the 1-day Sunday Only registrations] Each properly registered vehicle will receive a "Sunday Lucky Ticket" that you must fill out, sign and drop into the Grand Prize Giveaway box on the awards stage after 1:30PM on Sunday of each of the four Events noted above, and you will be automatically entered.
Employees, consultants, subcontractors, and agents of GoodGuys, Goodguy Enterprises, Inc., GoodGuys Rod and Custom Association, and Vintage Drag Racing Association, the Stations; as well as their spouses and dependents, are ineligible to enter this Contest or to win the Contest prize. Employees of the Stations, their licensees, corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the San Francisco metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
2. Multiple Contest Entries
You may enter each Contest by performing any one of the three activities (A, B, or C) listed above for this Contest. You can do these activities in any order, but you must be timely for each entry and you must follow all the Official Rules specified herein. Forms and entries must be completed in legible English please.
3. In-Person Participants Drawing to Select Contest Finalists from Among the In-Person Participants
Enter in-person at the events on the dates and times listed above. Fifteen (15) Finalists will be selected from In-Person entries. Enter your first name and last name, complete address, city, state, zip code, home telephone number, e-mail address, your date of birth and CELL PHONE number in the official entry form prior to each booths deadline noted above. All booths are located at the Alameda County Fairgrounds in Pleasanton, California, during the 2009 GoodGuys Events.
All In-Person entries from each event will be combined, and four (4) Finalists will be selected in a random drawing from entries collected on the Monday after each weekend GoodGuys Event at the CBS Radio Office at 865 Battery Street, San Francisco, California, 94111.
1. March 28-29, 2009 random drawing for valid and timely In-Person entries will be drawn and four (4) Contest Finalists will be chosen and contacted after the random drawing.
2. May 30-31, 2009 random drawing for valid and timely In-Person entries will be drawn and four (4) Contest Finalists will be chosen and contacted after the random drawing.
3. August 22-23, 2009 random drawing for valid and timely In-Person entries will be drawn and four (4) Contest Finalists will be chosen and contacted after the random drawing.
The weekend event for the 20th Autumn Get-Together (November 14-15, 2009) is where all of the Contest Finalists will come together for the Grand Prize drawing. However, there are still more Contest Finalists to be entered into the Grand Prize Random Drawing. Therefore, the last random drawings for Contest Finalists will be conducted “live” at the 20th Autumn Get-Together as follows.
1. November 14, 2009 after all entries are obtained on that day, a random drawing will be conducted “live” at the LIVE 105 booth at approximately 3:30PM (PT). Only two (2) Contest Finalists will be selected. Each Contest Finalist (except Finalists selected on November 15, 2009) will be provided two (2) tickets to attend the GoodGuys 20th Autumn Get-Together on Sunday November 15, 2009 to participate in the Grand Prize final drawing.
2. November 15, 2009 after all entries are obtained, a random drawing will be conducted “live” at the LIVE 105 booth at approximately 1:30PM PT. Only one (1) Contest Finalist will be selected.
4. On-Line Participant Random Drawing to Select a Contest Finalist from Among the On-Line Participants
A total of six (6) Contest Finalists will be selected in the Random Drawing conducted at the CBS Radio Offices on or after November 6, 2009. There may be more than one (1) On-Line Participant alternate Contest Finalist selected in the Random Drawing in the event a Contest Finalist is not eligible or must forfeit their rights to the Contest prize. From the pool of identified On-Line Participants, six (6) individual will be selected as a Contest Finalist to be entered into the Final Drawing(s) for the Contest prize. The Co-Promotional Partners are not responsible for any change(s) of address information or of any erroneous information of an On-Line Participant in the official On-Line Participants records.
5. Official Participants at GoodGuys 2009 Events
Each person that registers and officially enters their vehicle with GoodGuys for participation in one of the specified Pleasanton GoodGuys 2009 Events is an “Official Participant”. When registering and obtaining their vehicle number and documents, each Official Participant will receive a "Sunday Lucky Ticket" that identifies them. However, the 1-day [Sunday Only] registrations DO NOT receive a Sunday Lucky Ticket and will not be eligible to be an Official Participant for this Contest. All of the Official Participants at each of the Events that have filled out, signed and dropped their Sunday Lucky Ticket into the Grand Prize Box on the awards stage after 1:30PM PT on Sunday of each Event will be entered into the random drawing during the awards ceremony for that Event (Note: this time may be changed due to weather at the Event). On the Sunday of that Event, one (1) Sunday Lucky Ticket will be drawn from the Grand Prize Box for the Co-Promotional Partners 2009 Giveaway Contest for the 1965 Buick Le Sabre per Event, for a total of four (4) Contest Finalists.
If the Official Participant identified on that drawn ticket has filled out and signed their Sunday Lucky Ticket and is:
(i) present at the awards ceremony on that Sunday of the Event;
(ii) has their vehicle with them that was registered at the Event; and
(iii) is able to immediately and personally come up to the drawings announcer to be recognized.
Then that person will be selected as a Contest Finalist to be entered into the Final Drawing for this Contest prize. However, if the person identified on the Sunday Lucky Ticket drawn for this Contest has either not completed and signed their ticket, or is not present at the drawing with their registered vehicle or is unable to promptly come up to the awards stage to be recognized by Co-Promotional Partners as the Contest Finalist, then that person will be disqualified and another Sunday Lucky Ticket will be drawn until a Contest Finalist is ultimately selected at that Event. Any review of Co-Promotional Partners staff determinations regarding the eligibility and selection of Contest Finalists shall be made by the independent judge(s) for this Contest, whose decisions and discretion in these matters are final. The independent judge(s) reserve the right to draw at least one (1) alternate Contest Finalists from the Grand Prize Box on the Sunday of each such Event as a precaution if the Contest Finalist is not eligible or must forfeit their rights to the Contest prize.
There will be a total of four (4) Contest Finalists drawn from among the Official Participants that had their Sunday Lucky Ticket drawn for this Co-Promotional Partners 2009 Giveaway Contest for the 1965 Buick Le Sabre. GoodGuys recognizes that some people may register and enter one of the above identified Events using a “company or corporate” name as the participant’s name, however for the purposes of this Contest, only natural persons are eligible to be an Official Participant. Each Contest Finalist will be contacted by GoodGuys to determine if they are eligible and willing to comply with these Official Rules of the Co-Promotional Partners 2009 Giveaway Contest for the 1965 Buick Le Sabre and willing to accept the Contest Rules and/or the Contest prize under the terms and conditions set forth herein.
6. Notification to Contest Finalists Selected in Either Random Drawing
The Contest Finalists selected in either Random Drawing will be notified by a telephone call and/or by a letter sent via first class US Mail from Co-Promotional Partners specifying that the Contest Finalist must contact a specific official at Co-Promotional Partners offices (Except for November 14-15, 2009 drawings which are conducted “live”). To determine if the Contest Finalist is eligible to be awarded the prize and is able and willing to accept the Contest Rules and/or the prize under the terms and conditions set forth herein, to include making their own travel arrangements. The Contest Finalist is required to respond to a specific official at Co-Promotional Partners by a telephone call and/or by letter within five (5) calendar days of the first attempted delivery of the letter at the address provided by the Contest Finalist or the first attempted telephone call from Co-Promotional Partners. If the Contest Finalist either fails to contact that Co-Promotional Partners official and respond as required, or is otherwise unavailable to receive the notification for whatever reason, such that no response is received by 5:00PM PT on the fifth (5th) day following of the first attempted delivery or telephone call to the Contest Finalist, then any right or interest of the Contest Finalist in the Contest prize or this Contest shall be promptly forfeited. No other notification will be required to be made by Co-Promotional Partners to the Contest Finalist. If a Contest Finalist has forfeited their interest in the prize and this Contest, an alternate Contest Finalist may be selected at the Random Drawing and they will be declared the “Contest Finalist” of that Random Drawing by the independent judge. If an alternate Contest Finalist is selected by the independent judge as the “Contest Finalist”, then that alternate Contest Finalist must be found eligible to be awarded the prize (i.e. is able and willing to accept the Contest Rules and/or the prize under the terms and conditions set forth herein) and must comply with all Contest Rules as applied to the Contest Finalist. The Random Drawing will be conducted under the direction of independent judge(s) whose decisions are final on all matters relating to this Contest.
7. Final Drawing to Select the Winner from Among Contest Finalists
All Contest Finalists who are selected on or before November 6, 2009 will be given two (2) tickets to attend the GoodGuys 20th Autumn Get Together on Sunday November 15, 2009 to participate in the Grand Prize Final Event. All Contest Finalists will be notified by phone and then mailed a letter with instructions about the Grand Prize Final Event no later than November 9, 2009. The three (3) Contest Finalists who will be selected over the weekend of November 14 - November 15, 2009 in a random drawing from all eligible entries received at The 20th Autumn Get-Together on November 14-15, 2009 and will be notified immediately following the random drawing by telephone using the cell phone number provided on the valid entry form. The Co-Promotional Partners will make up to two (2) attempts to notify each Contest Finalist selected on November 14, 2009 and November 15, 2009, within one hour of the selection of the Contest Finalist. If a Contest Finalist cannot be reached by the second attempt, that Contest Finalist will be disqualified and an alternate Contest Finalist will not be selected. The one (1) Contest Finalist who will be selected from the private GoodGuys vendor participant ticket drawing that will be held right before the award ceremony on Sunday, November 15th and must be present to participate in the Grand Prize Buick Le Sabre Giveaway. Selection of the Grand Prizewinner will take place on November 15, 2009 at the Alameda County Fairgrounds. All prior Contest Finalists must check in at the LIVE105 Radio Booth located within the show at the Alameda County Fairgrounds, located at 4501 Pleasanton Avenue Pleasanton, CA 94566, no later than 1:00PM PT on November 15, 2009. Any Contest Finalist who has not checked in by 1:00PM PT will be disqualified and there will not be any alternate Contest Finalists selected. Co-Promotional Partners will not accept any stand-ins or proxies on behalf of an individual Contest Finalist. Starting at approximately 3:30PM PT, the Contest Finalists will be randomly called one at a time to come up and select a key. Depending on how many Contest Finalists arrive and check in on time, that number of keys will be placed in a container. Each Contest Finalist will select one (1) key which will be numbered and dictates the order contestants will try and start the Buick Le Sabre. The first Contest Finalist whose key starts up the Buick Le Sabre will be the Grand Prizewinner, at which point the Contest will end and no other Contest Finalists will have an opportunity to start the Buick Le Sabre. If for any reason none of the keys start the Buick Le Sabre, the Co-Promotional Partners will randomly select one (1) Grand Prizewinner from among all eligible Contest Finalists present at the Grand Prize Final Event. One (1) Grand Prizewinner will win the 65 Buick Le Sabre valued at $20,000.00. Odds of winning a Contest Finalist Prize of two tickets for the final event will depend upon the number of eligible entries received. Odds of winning the Grand Prize depend on the number of Contest Finalists present at the Grand Prize Final Event. Winner must be present at final drawing to win and claim prize. Co-Promotional Partners reserve the right to change winner selection process without advance notice and may substitute a lock in lieu of the Contest Finalists trying their keys in the Buick Le Sabre. Winner must be present, be at least 18 years old, and possess a valid driver’s license and proof of auto insurance. The Winner must agree to execute the Co-Promotional Partners Prize Acceptance and Liability/Publicity Release form and an Affidavit of Eligibility form and then promptly deliver the executed forms to the Co-Promotional Partners official by November 30th, 2009 and before the Winner takes actual possession of the Grand Prize.
8. Eligibility Requirements
This Contest is open only to U.S. residents of the 50 states except New York, Florida, or Rhode Island who are 18 years of age or older and are valid licensed drivers with automobile insurance at the time of the Random Drawings from which Contest Finalists are selected. Non-compliance with any of the Official Contest Rules may result in disqualification. Co-Promotional Partners reserves the right to substitute cash or another vehicle of equal or greater value in the event the Grand Prize is substantially damaged or destroyed before the winner takes possession of the prize. This Grand Prize will be given “AS IS”, after usage and travel of the vehicle for publicity purposes to promote Co-Promotional Partners and the Grand Prize at numerous Co-Promotional Partner Events in California.
9. Finalist Prizes
Twenty-four (24) Finalist Prizes will be awarded. Each Contest Finalist (except Finalists selected on November 15, 2009) will be provided two (2) tickets to attend the GoodGuys 20th Autumn Get-Together on Sunday November 15, 2009 to participate in the Grand Prize event. The Approximate Retail Value of each Finalist Prize is: $30.00. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
10. Grand Prize
One (1) Grand Prize will be awarded. The Grand Prize is the completed 1965 Buick Le Sabre. The prize does not include any other travel expenses or any lodging, meals, rental cars or other expenses incurred by the Contest Finalists in attending the Final Drawing or the Winner in accepting and taking possession of the prize. The Winner will be given title to the Grand Prize, but only after the Winner has executed Co-Promotional Partners ' Prize Acceptance and Liability/Publicity Release form and Affidavit of Eligibility form and provide valid proof of insurance. Co-Promotional Partners reserve the right to substitute cash or another vehicle of equal or greater value for the prize. The Approximate Retail Value of the Grand Prize is $20,000.00. Grand Prize winner will pick up the prize within fourteen (14) days of winning from the GoodGuys Garage at 1071 Serpentine Lane, Pleasanton, CA 94566.
11. “AS IS”
Upon the Winner completing and executing Co-Promotional Partners' Affidavit of Eligibility form and Prize Acceptance and Liability/Publicity Release form, the Winner shall be responsible to accept the Contest prize “AS IS”. The Winner is solely responsible for all car title, license and registration fees, freight, delivery, additional equipment, all federal, state and local taxes, gasoline, vehicle maintenance, insurance and all other fees and expenses associated with the receipt of the prize vehicle. Co-Promotional Partners is not responsible for any unauthorized human intervention or other causes beyond the control of Co-Promotional Partners that corrupt or improperly affect the administration, security, fairness or proper play or conduct of this Contest. Co-Promotional Partners will not be responsible to award any value in excess of the value listed in these Official Rules. The Stations accept no responsibility for repairing any real or supposed damage to the Prize from this Contest. The Co-Promotional Partners have not made and are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle.
12. RELEASE OF LIABILITY
Upon acceptance of the prize, the Winner forever releases from any and all liability, loss, harm, damage, cost or expense whatsoever, regardless of how it was incurred, and including without limitation, any and all claims for property damage, personal injury, and/or death which may occur in connection with the Winner’s acceptance, ownership, possession and/or use of the prize, each of the following:
GoodGuys and any person or entity that participated in the building, assembling and/or manufacturing of the 1965 Buick Le Sabre; and all of the other contributors, parts suppliers, and/or sponsor’s of this Co-Promotional Partners 2009 Giveaway Contest for the 1965 Buick Le Sabre; Goodguy Enterprises, Inc., GoodGuys Rod and Custom Association, GoodGuys, and its owners, employees, representatives, suppliers, agents, affiliates, associates and advertisers; officials and members of the GoodGuys Rod and Custom Association; any Co-Promotional Partners, individual or entities involved with this Contest, its promotion, and public relations and production agency associated with this Contest; and the independent judge(s) (whose decisions for this Contest are final) on all matters relating to the Co-Promotional Partners 2009 Giveaway Contest for the 1965 Buick Le Sabre and/or the Contest prize.
13. Contest Rules Govern
Each person entering this Contest agrees to be bound by these Official Rules and by the decisions of the independent judge(s) in the selection of the Contest Finalists and the Winner. By accepting these Official Rules, each Contest Finalists and the Winner expressly authorize Co-Promotional Partners, and their employees, agents and representatives, to use their name, address and/or their photograph and/or likeness for publicity or advertising purposes without further compensation or permission, except where prohibited by law. All forms, documents and recorded information regarding the Official Participants, received On-Line Entry(s), and Members used in this Contest are the exclusive property of Co-Promotional Partners and will not be returned.
14. Winner Identification
The identification of the Winner will be made available after December 31, 2009 to those sending a written request (in English only) for that information, together with a separate, stamped (first class mail), and self addressed envelope (#10) to:
